Terms of Use

1. Acceptance and eligibility

These Terms of Use form an agreement between you and EpiLingo ("EpiLingo," "we," "us," or "our"). They apply when you download, access, purchase, or use the EpiLingo application, website, and related services (together, the "Services").

By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. You must be at least 18 years old and legally able to enter into this agreement.

2. The EpiLingo service

EpiLingo is a voice-first AI English coach. It provides conversation scenarios, pronunciation practice, transcripts, learning feedback, progress features, and other educational tools. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for lawful, non-commercial learning purposes.

Features may differ by device, region, account type, or subscription. You are responsible for compatible equipment, internet access, carrier charges, and installing available updates.

3. AI-generated content and learning results

The Services use artificial intelligence to generate dialogue, corrections, scores, explanations, and recommendations. Similar inputs may produce similar outputs. We do not guarantee a particular language level, test result, educational outcome, or rate of progress.

EpiLingo is an educational product, not a medical, mental-health, legal, financial, immigration, employment, or emergency service. Do not use AI output to make high-impact decisions about yourself or another person. Seek a qualified professional where appropriate.

4. Accounts and security

You may use a guest account or sign in through a supported identity provider. You must provide accurate information, keep your device and credentials secure, and promptly notify us if you believe your account has been compromised. You are responsible for activity under your account unless applicable law says otherwise.

Do not create accounts through automated means, impersonate another person, transfer an account, or attempt to bypass account, access, or subscription controls.

5. Subscriptions, billing, and cancellation

Some features require a paid subscription. Prices, billing periods, included features, trial terms, and any introductory offer are shown before purchase and may vary by storefront or region.

Subscriptions renew automatically unless you cancel them through your App Store account settings at least as required by the storefront before the renewal date. Deleting the app or your EpiLingo account does not necessarily cancel an App Store subscription.

Apple processes App Store payments, cancellations, and refund requests under its own terms. Except where required by law or the applicable storefront rules, charges are non-refundable. We may change future subscription prices or features with notice required by the storefront or law.

6. Your content

"Your Content" includes voice input, transcripts, prompts, messages, profile information, onboarding answers, and other material you submit through the Services. You retain any rights you have in Your Content.

You grant us and our service providers a worldwide, non-exclusive license to host, process, reproduce, transmit, and adapt Your Content only as needed to operate, secure, support, troubleshoot, and improve the Services as described in our Privacy Policy. We do not claim ownership of Your Content. We will not use Your Content to train generalized AI models unless we obtain any permission required by law.

You must have the rights and permissions needed to submit Your Content. Do not submit confidential information, another person’s personal information, or material that violates law or these Terms.

7. Acceptable use

You may not use the Services to:

• break the law, infringe rights, deceive, harass, threaten, exploit, or harm anyone;
• create sexual content involving minors or otherwise endanger a minor;
• promote violence, hate, terrorism, self-harm, or dangerous illegal activity;
• upload malware, probe security, disrupt infrastructure, scrape at scale, or evade safeguards;
• reverse engineer, copy, resell, sublicense, or create a competing service from the Services except where law expressly permits it;
• present AI output as verified professional advice or use it for prohibited high-impact decisions.

Our Community Guidelines provide more detail and are part of these Terms. We may investigate suspected violations and remove content, restrict features, suspend accounts, preserve evidence, or report conduct when reasonably necessary.

8. EpiLingo ownership

The Services—including software, design, branding, characters, text, audio, graphics, databases, and our content—are owned by EpiLingo or its licensors and protected by intellectual-property laws. These Terms grant only the limited right to use the Services described above. No other rights are transferred to you.

Feedback you voluntarily provide may be used without restriction or compensation, provided we do not publicly identify you without permission.

9. Third parties, updates, and availability

The Services rely on third parties, including app stores, identity providers, analytics, infrastructure, and AI providers. Their terms and privacy practices may also apply. We are not responsible for third-party services that we do not control.

We may add, change, suspend, or discontinue features and may release required updates. We do not guarantee that the Services will always be available, error-free, secure, or compatible with every device or operating-system version.

10. Suspension and termination

You may stop using the Services at any time and may request account deletion through the app or support. We may restrict or terminate access if you materially violate these Terms, create risk or legal exposure, fail to pay applicable charges, or if we discontinue the Services.

Provisions that by their nature should survive termination—including ownership, payment obligations, disclaimers, and limits of liability—will survive. Account deletion is handled as described in our Privacy Policy and does not automatically cancel subscriptions managed by a storefront.

11. Disclaimers and liability

To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

To the fullest extent permitted by law, EpiLingo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or opportunities arising from the Services. Our total liability for claims relating to the Services will not exceed the greater of the amount you paid EpiLingo during the 12 months before the event giving rise to the claim or USD 100. These limits do not apply where prohibited by law.

If part of these Terms is unenforceable, the remaining terms remain effective. Our failure to enforce a provision is not a waiver. We may update these Terms and will post the new effective date; where required, we will provide additional notice or request consent.
